It is up to the employer whether they take any notice of that but I can't see any cruise operator being prepared to employ him now.

This is why a very simple arrest, no more than compelling someone to come in for an interview, is not a minor matter. This is not really the fault of the police; they didn't create the hysteria around CRB checks.

I don't think that he will have any come-back against the accuser as this one wasn't necessarily malicious. He may just be unwell. There's nothing unusual about aggravated people turning up at police stations claiming to have been the victim of harassment. It was for the police to screen and investigate the complaint. They tend to act when complaints are manipulative and have increased their responses to that in the last six months, but usually where there has been a significant and deliberate waste of police time.

The trouble seems to have been the officers mis-used the street bail procedure and the use of 4A (which is not a first-resort charge as the CPS explain) because there was never any need to arrest Ledger at all. Perhaps they thought that as it was street-bail, it didn't 'count'.Woman on a Rafthttps://www.blogger.com/profile/08897415591130901416noreply@blogger.comtag:blogger.com,1999:blog-6068105406305319114.post-20237120224202207702011-04-29T07:22:00.758+01:002011-04-29T07:22:00.758+01:00WoaR,

Am I right in thinking that his arrest will now appear on every enhanced CRB check in the future? As his work includes entertaining children might this factor harm his ability to trade, and if so does he have any comeback against the malicious accuser?Submarinernoreply@blogger.comtag:blogger.com,1999:blog-6068105406305319114.post-15955308130038592752011-04-29T03:00:04.447+01:002011-04-29T03:00:04.447+01:00A classic example of the absurdity of this branch ...A classic example of the absurdity of this branch of thought-crime.

It is an unprincipled nonsense that exactly the same thing can be said or done by two people at the same time to the same audience and one commits a criminal offence because he intends to be offensive while the other is wholly innocent because he does not.

These laws should be taken off the statue book. In the meantime I wish we had police officers with the common sense to say "for goodness sake, it's only a bloody song".

Incidentally, I had not heard that song since 1974 and had no recollection of Carl Douglas being such a good singer.TheFatBigothttps://www.blogger.com/profile/17255526385076528633noreply@blogger.comtag:blogger.com,1999:blog-6068105406305319114.post-87573128275654159502011-04-28T19:54:44.050+01:002011-04-28T19:54:44.050+01:00It didn't get as far as the CPS - he was relea...It didn't get as far as the CPS - he was released without charge due to lack of evidence.

The precise heading quoted by the Hampshire spokesperson was the Public Order Act 1986 s.4A and the police implied, but provided no evidence, that there was racial abuse surrounding the playing of the song, rather than the song itself. 4A can be racially aggravated.

He was street-bailed (30A - 30D PACE) under a duty to attend the police station by appointment. See the guidance for Hampshire:

http://www.hampshire.police.uk/NR/rdonlyres/A914C82D-C701-444F-96CE-DF8FBC487440/0/00901.pdf

It is possible to imagine a situation where a heckler kicks-off and a musician bites back, but this does not appear to have happened. Ledger is a career entertainer in holiday resorts and on cruise ships so he is used to working with the public.

Rather, the complainant appears to have taken umbrage at being told to stop swearing - because families with children don't appreciate it in a family bar and grill - and became enraged that the song wasn't immediately stopped the second time he tried to intervene.Woman on a Rafthttps://www.blogger.com/profile/08897415591130901416noreply@blogger.comtag:blogger.com,1999:blog-6068105406305319114.post-55021549867970351942011-04-28T16:19:38.594+01:002011-04-28T16:19:38.594+01:00Does this mean the song can't be played on rad...Does this mean the song can't be played on radio or TV now?
